US Immigration and Customs Enforcement (ICE) Limits Clarified by Experts

The incidents, which include videos of ICE agents stopping, questioning, and detaining residents in Minneapolis, have sparked outrage and confusion over what laws govern these interactions.

According to federal law, immigration agents are authorized to arrest and detain individuals believed to have violated immigration law. However, the Fourth Amendment of the US Constitution protects citizens against unreasonable searches and seizures, regardless of their immigration status. This means that ICE agents must meet certain standards when interacting with individuals in public or private spaces.

In general, ICE officers can question someone in a public place without needing “reasonable suspicion” that they have committed a crime or are in the US illegally.
