Chilean Court Considers Criminal Complaint Against Former Israeli Sniper
A Chilean court is considering a criminal complaint against Rom Kovtun, a former Israeli army sniper who served in Gaza during Israel’s conflict with Palestinians. The complaint was filed by the Hind Rajab Foundation (HRF), a Belgium-based organization that aims to hold individuals accountable for war crimes and human rights abuses.
Kovtun, an Israeli-Ukrainian national, served as a sniper in Israel’s 424th Shaked Battalion in Gaza. According to his own social media posts, he was holidaying in Chile at the time of the complaint being filed. The HRF has accused Kovtun of war crimes, genocide, and crimes against humanity.
Chile’s domestic law incorporates the International Criminal Court’s (ICC) Rome Statute, which allows courts to exercise universal jurisdiction in certain cases. This means that if it is clear that a person will not be tried in their country of origin, Chilean courts can consider prosecuting them for crimes committed abroad.
The HRF has assembled a team of lawyers and activists to build legal cases against individuals accused of war crimes. In this case, the complaint alleges that Kovtun played a key role in the siege of Gaza’s largest hospital, al-Shifa, which resulted in the deaths of hundreds of civilians, including doctors, nurses, and patients.
Kovtun is not the first Israeli soldier to be targeted by the HRF. The organization has previously filed complaints against other former Israeli soldiers who served in Gaza. Chile has a significant Palestinian diaspora community, but this may not affect the outcome of the case. The court’s decision will depend on the merits of the complaint and the applicable laws.
The case is ongoing, and it is unclear when or if Kovtun will be tried.
