DC Pipe Bomber Ordered to Remain in Custody Before Trial

Federal Magistrate Judge Matthew Sharbaugh has denied a request for pre-trial release of Brian Cole, a 30-year-old man charged with planting two pipe bombs outside the headquarters of the Democratic and Republican national parties on January 6, 2021.

Cole had confessed to placing the explosives, which were intended to detonate hours before President Donald Trump’s supporters stormed the US Capitol in an effort to overturn the 2020 election results. According to prosecutors, Cole stated that he hoped the explosives would detonate and cause a reaction.

The Department of Justice has argued that there are no conditions of release that can reasonably protect the public from the danger posed by Cole. The magistrate judge concluded that if the plan had succeeded, it could have resulted in devastating consequences, including serious property damage, injuries, and loss of life.

Cole’s defense team had requested pre-trial release on home detention with GPS monitoring, citing his lack of a criminal record, autism spectrum disorder, and obsessive-compulsive disorder. However, prosecutors argued that Cole continued to purchase bomb-making components after the January 6 riot and expressed impulsive motivations for his actions.

The US president was later indicted for his role in fomenting the January 6, 2021, riot, but the case was abandoned after his election victory in 2024. Cole faces up to 10 years of imprisonment on one charge and up to 20 years of imprisonment on a second charge if convicted.

Cole’s lawyers had argued that he does not pose a danger to the community, citing his stable home life with his parents in Woodbridge, Virginia. However, Judge Sharbaugh expressed concerns about Cole’s sudden motivation for planting the pipe bombs and the potential for similar impulsive conduct in the future.
